Yardi - SMS Communication Terms of Service

1. Agreement to Terms
By opting in to receive SMS messages from Yardi, operated by Yardi Systems, Inc., you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our SMS services.
2. SMS Program Description
Our SMS program allows us to send you text messages related to:
- Business updates and announcements
- Service notifications and alerts
- Customer support communications
- Promotional offers (if opted in)
- Important account or service information
3. Consent and Opt-In Requirements
By providing your mobile phone number and confirming your opt-in to our SMS program, you:
- Consent to receive SMS messages from Yardi Systems, Inc.
- Confirm that you are the authorized user of the mobile phone number provided
- Acknowledge that you are at least 18 years of age or have parental consent
- Agree that consent is not a condition of purchase or use of our services

- Acknowledge that you can withdraw consent at any time using the opt-out methods provided
Important: Your consent applies specifically to receiving text messages from Yardi at the mobile number you provide. This consent remains valid until you opt out using the methods described in these Terms.
4. Message Frequency and Charges
Frequency
Message frequency varies depending on your interaction with our services and the nature of our business relationship. You may receive up to 5 messages per month.
Charges
Message and data rates may apply according to your mobile service provider's plan. You are responsible for all charges related to text messages received from us.
5. Opt-Out Instructions and Help
How to Opt Out
You may opt out of our SMS program at any time using any of the following methods:
- Reply "STOP" to any SMS message from us
- Send an email to info@yardi.com requesting to be removed
- Call us at (805) 699-2040 and request opt-out
After you opt out, you will receive a final confirmation message confirming that you have been removed from our SMS program. No further messages will be sent unless you explicitly opt in again to our program.

Re-Opting In
If you have previously opted out and wish to receive messages again, you must go through our opt-in process again. Simply replying to old messages or texting us will not automatically re-subscribe you to our program.
6. Carrier and Device Limitations
Not all mobile devices or carriers may be supported. We are not responsible for delivery delays or failures due to carrier or device limitations.
7. Prohibited Uses
You agree not to:
- Use our SMS service for any unlawful purpose
- Provide false or misleading information
- Use someone else's phone number without permission
- Attempt to interfere with or disrupt our services
- Send spam or unsolicited messages through our platform
8. Privacy and Data Protection

9. Service Availability
We strive to provide reliable SMS service, but we cannot guarantee:

- Compatibility with all devices and carriers
10. Limitation of Liability
To the fullest extent permitted by law, Yardi Systems, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our SMS service.

Our SMS program is fully compliant with The Campaign Registry requirements and all applicable messaging regulations. This includes:
Brand Registration
- Yardi Systems, Inc. is registered as a verified brand with The Campaign Registry
- Our business information, including EIN and business details, are verified and on file
- We maintain current registration status and comply with all ongoing requirements
Campaign Registration
- All SMS campaigns are registered with The Campaign Registry before deployment
- Campaign use cases are accurately described and approved
- Message content and frequency align with registered campaign parameters
Regulatory Compliance
Our SMS program complies with all applicable laws and regulations, including:
- The Campaign Registry: Brand and campaign registration requirements
- Telephone Consumer Protection Act (TCPA): Consent and opt-out requirements
- CAN-SPAM Act: Commercial message identification and opt-out
- CTIA Guidelines: Messaging best practices and consumer protection
- FCC Regulations: Wireless communication rules and consumer rights
- Carrier Requirements: Individual carrier policies and filtering standards
Consent Records
We maintain detailed records of all SMS consent as required by The Campaign Registry and applicable regulations. These records include:
- Date and time of consent
- Method of consent (web form, verbal, etc.)
- Phone number and associated consent

12. Changes to Terms
